The twists and turns of the (pre)litigation procedure: how to get prepared?

Lecturer: Nathalie de MONTIGNY, lawyer at the Brussels Bar, for the Louis European Law legal firm.

The issues to be discussed during the Conference will address mainly the pre-litigation stage and procedural delays. We will discuss, in a concise and pragmatic way, a variety of issues that will allow you to look forward more calmly to the various steps of Articles 90 and 91 of the Statute.

The request: In which circumstances? How to submit it? What tone should be used? Which annexes should be attached? Should I detail it or should I be brief? Is it required to consult a lawyer at this stage?

Missions: the question of credit cards

For many years, the service to missions has been in decline, both in terms of quality and support for those sent on missions. In practice, the official or agent pays the mission expenses in advance, which the institution then reimburses with extremely variable delays.

The end of the system of advance payment of costs used by the Commission in the past – which also enabled savings on human resources – was linked to the issuing of a credit card with payment terms of 60 days. This was supposed to prevent colleagues from being debited before they had received their reimbursement. 

The Commission has reduced so-called staff facilities through "modernisation measures", as they are currently known.

Improving the Health Insurance Fund, is it possible? Can contributors expect better cover?

The operating profit of the Joint Sickness Insurance Scheme (Régime Commun d'Assurance Maladie - RCAM) has once again resulted in a surplus. These financial reserves are a cushion against future risks; but could annual surpluses not be used to fund more benefits for our greater comfort? Good management should benefit all members. After all, it is our money.

This is why we propose five measures for colleagues, making reasonable and intelligent use of part of the current and future surpluses generated by the health insurance fund.
